1. Quiet Sleep – Privacy Statement

Quiet Sleep, hereinafter referred to as (“Kuwait Sleep”), is committed to protecting the privacy and security of your personal data, in accordance with the Personal Data Protection System1 which entered into force in the Kingdom of Saudi Arabia as of September 14, 2023 AD, coupled with its executive regulations2 issued by the Saudi Data Authority. and Artificial Intelligence (SDAIA).

Our Personal Data Protection and Privacy Policy sets out the purpose for collecting personal data, the nature of the data collected, the means used to collect your personal data, the processing, storage and destruction of your personal data, information about your rights as a personal data owner/data subject and how you can exercise your rights.

Quiet Sleep is committed to processing your personal data in a way that supports your rights to privacy and confidentiality to the highest degree, in accordance with the provisions of the regulations in force in the Kingdom of Saudi Arabia.

Personal Data Protection System issued by Royal Decree No. (M/19) dated 02/09/1443 AH corresponding to 09/16/2021 AD, and amended by Royal Decree No. (M/148) dated 09/05/1444 AH corresponding to 03/27/2023 AD.

The executive regulations for the personal data protection system and the system for transferring personal data outside the geographical borders of the Kingdom issued by the Saudi Data and Artificial Intelligence Authority (SDAIA) on 09/07/2023 AD.

2 . Explanations and definitions

A - Actual interest : refers to any moral or material interest you (the data subject) has that is directly related to the purpose of processing personal data, and such processing is necessary to achieve that purpose.

B - Controller : means Quiet Sleep.

T - Collection : means the collection of personal data by the “controller” in accordance with the provisions of the system, either from you as a “data subject” directly, or from your representative, or from any legal guardian over you as a data subject, or any other party.

D - Disclosure: means the process of enabling any person other than the controller and the processor, as the case may be, to access, collect or use personal data by any means and for any purpose.

C - Destruction: refers to any action taken regarding personal data that renders it unreadable and irretrievable, or makes it impossible to identify you or the identity of the data subject/owner of the personal data in question.

H - Explicit consent: means the direct and explicit consent provided by the owner of the personal data/data subject in any form that clearly indicates your acceptance as the data subject to the processing of your personal data as a data subject in a manner that cannot be interpreted otherwise, and which can be proven to have been obtained.

G - Legitimate interest: refers to any necessary interest of the Controller that requires the processing of personal data for a specific purpose, provided that this does not adversely affect your rights and interests as the personal data owner/data subject.

D - Personal data: means any data, regardless of its source or form, that may lead to the identification of you specifically as an individual, or may allow, directly or indirectly, to identify you as an individual, including by name, personal identification number, personal records and assets, and numbers. Banks, credit cards, photos and videos of you as an individual, and any other data of a personal nature.

Y - Processor: means any public entity, natural person or private legal person (including holding companies, subsidiaries or affiliates of Kuwait Sleep) that processes personal data for and on behalf of Kuwait Sleep (controller).

T - Processing: means any operation performed on personal data by any means, whether manual or automated, including collecting, recording, saving, indexing, organising, coordinating, storing, modifying, updating, merging, consolidating, retrieving, using, disclosing, sending, publishing, sharing, pairing, blocking, erasing and destroying personal data.

G - Sensitive data: means personal data that reveals racial or ethnic origin, religious, intellectual or political belief, data related to the record of convictions and security criminal offences, biometric or genetic data for the purpose of identifying a person, or health data. , or data indicating that one or both of the individual's parents are unknown.

Q - Transfer: means transferring personal data from one place to another for the purpose of processing.

U - Necessary interest: means any interest necessary to preserve your life.

Y - You/Your: refers to the individual who is the owner of the personal data/data subject to whom the personal data relates.

Unless specifically stated otherwise, the terms used in this Personal Data Protection and Privacy Policy have the same meanings in common parlance, as defined in the Personal Data Protection Law and its Implementing Regulations.

3. Purpose of collecting personal data

Personal data refers to data that allows QuietSleep to know your identity details, which can be used to identify, contact or locate you (such as name, age, gender, postal address, telephone number and email).

Quiet Sleep may ask you to provide your personal data relevant to enabling us to serve you in a way that enables us to enhance your experience by creating awareness of opportunities available with us and/or informing you of new product arrival campaigns, sales promotions, and discount campaigns on products and services that may be of interest to you based on your previous interaction with us. .

We may use a third-party service provider to help us secure certain features and features of our Service. Our service provider will receive your information on our behalf and will not be permitted to use it for any other purpose.

4. The nature of the personal data collected

Your personal data collected may be in physical and/or electronic form and may include name, address, contact information (telephone/mobile number), email address, national ID, passport, bank account/credit card/debit card details, age, gender, health data and the like. , which are most relevant to the scenario. For example, an applicant for a vacancy with us may share his/her CV with us and, upon selection, share other personal data necessary to process his/her application for a work visa, employee insurance, and the like. 5. Means used to collect personal data

Quiet Sleep collects your personal data when you provide it to us, as a potential or returning customer, when you answer a survey, register for events or campaigns, register for personalized services, purchase a product and/or visit our website, stores, And/or contact our customer support.

QuietSleep may collect your personal data, including your location data, your IP address, device ID, and the like, in addition to any other information you share with us during your interaction with us.

6. Processing of personal data

The meaning of “data processing” is defined in Clause 2(t) of this Personal Data Protection and Privacy Policy, QuietSleep may process/use your personal data for the following purposes:

A - To provide our products and maintain our services, including monitoring your preferences in purchasing and selecting services in order to enable us to provide you with the latest updates on the best offers arising from our campaigns and promotions.

B - To perform a contract: to develop, comply with and perform the purchase contract for the products, items or services you have purchased, or any other contract with us through our previous interaction, in any form.

C - To contact you by email, phone calls, SMS or any other similar form of electronic communication, such as mobile application notifications regarding updates or informational communications related to contracted functions, products or services, including security updates. When it is necessary or reasonable to implement it.

d - To provide you with news, special offers and general information about other goods, services and events we offer, similar to those you have already purchased or inquired about unless you have chosen not to receive such information.

C - To manage your request to attend, and to manage any requests you have sent to us.

7. We may share your personal data/information in the following circumstances:

A- With service providers:

We may share your personal data/personal information with service providers in order to monitor and analyze the use of our products and/or services and/or to contact you.

B- With regard to commercial transfers:

We may share or transfer your Personal Data/Information in connection with, or during negotiations of, any merger with, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

T- With business partners and group companies:

We may share your personal data/information with our business partners and group companies (holding companies, subsidiaries and affiliates) in order to provide you with certain products, services or promotions.

D- With other users:

When you share personal data/personal information, or otherwise interact in public with others, such information may be viewed by everyone and may be publicly distributed abroad.

C- With your consent:

We may disclose your personal data/information for any other purpose with your consent.

8. Retention of your personal data

QuietSleep will retain your personal data only for as long as is necessary for the purposes set out in this Personal Data Protection and Privacy Policy. We will retain and use it to the extent necessary to comply with our regulatory obligations, resolve disputes, and enforce our agreements and regulatory policies that are subject to the instructions of regulatory authorities, such as the Saudi Data and Artificial Intelligence Authority (SDAIA) and any other government body, and to comply with other rules and regulations applicable within the Kingdom of Saudi Arabia.

9. Transfer of your personal data

· Your information, including personal data, is processed in our office in Jeddah, Kingdom of Saudi Arabia, and in any other locations where the parties involved in the processing are located. This means that your personal data may be transferred and held outside the Kingdom of Saudi Arabia.

· Your acceptance of this Personal Data Protection and Privacy Policy, followed by your provision of the requested personal data/information, indicates your consent to the transfer of such data.

Quiet Sleep will take all steps reasonably necessary to ensure that personal data provided to us is treated securely and in accordance with this Personal Data Protection and Privacy Policy, and that such personal data will not be transferred or shared to any organization or country unless there are adequate controls in place to ensure the security of Your personal data and information.

10. The right to update, amend or request deletion of your personal data

As the data subject/owner of personal data, you have the right to delete or request Quiet Sleep's assistance in deleting the personal data we have collected about you.

You may update, modify or delete your information at any time by emailing us to request it.

However, please note that we may need to retain certain information where we have a regulatory obligation or basis to do so.

11. Disclosure of your personal data

QuietSleep may, under certain circumstances, be required to disclose your personal data if required to do so by law or in response to valid requests from public bodies (such as a court or government agency).

The Company may disclose your Personal Data when it believes in good faith that such action is necessary to:

A- Taking into account the protection of the sovereignty of the Kingdom of Saudi Arabia.

B- Compliance with a legal obligation.

T- Protect and defend the rights or property of Kuwait Sleep.

D- Prevent or investigate any potential violations in relation to the products/services.

C- Protecting the personal safety of Kuwait Sleep customers or the public in general.

H- Protection from regulatory liability.

12. Security of your personal data

The security of personal data is a top priority for Quiet Sleep, and is protected through physical, technical and administrative safeguards that comply with applicable regulations. QuietSleep will use reasonable efforts and procedures to secure our customers' personal data against misuse and loss, as well as unauthorized access, modification or disclosure. QuietSleep has security measures in place to ensure the protection of your personal data and adherence to standard encryption standards for data transfer. At Quiet Sleep, we make sure that our employees and affiliates are aware of the importance of protecting personal data and maintaining its confidentiality.

13. The right of regular guardians

QuietSleep does not knowingly collect personal data from anyone under the age of 18, without parental/legal guardian consent. If you are a parent/guardian and you are aware that your child has provided us with Personal Data, please contact us.

If QuietSleep learns that it has collected Personal Data from anyone under the age of 18 without verification of parental consent, QuietSleep will be required to take steps to remove that information from our database.
